Understanding Inheritance Laws — How Property is Divided Among Heirs

Why Understanding Inheritance Matters

When a loved one passes away, understanding how their property should be distributed is crucial. Without proper knowledge, families face conflicts, legal battles, and emotional stress.

Inheritance laws vary significantly by:

  • Country (Bangladesh, India, USA)
  • Religion (Muslim, Hindu, Christian)
  • State or region
  • Presence or absence of a will

Our Inheritance Calculator simplifies this complexity by computing exact inheritance shares based on the applicable law.

Inheritance in Bangladesh

Bangladesh follows personal laws based on religion:

Muslim Inheritance Law

Islamic inheritance (Faraid) is one of the most structured systems:

  • Fixed Shares (Quranic Heirs): Spouse, parents, and children receive guaranteed portions
  • Residuary Heirs: Remaining property goes to male agnatic relatives
  • General Rule: Sons receive twice the share of daughters in the same class

Example (Muslim Law): A man leaves behind a wife, one son, and one daughter:

Heir Share
Wife 1/8 (12.5%)
Son 7/12 (58.3%)
Daughter 7/24 (29.2%)

Hindu Inheritance in Bangladesh

  • Follows Dayabhaga school of Hindu law
  • Property can only be inherited after the owner's death
  • Sons and daughters have inheritance rights
  • Wife is a Class I heir

Christian Inheritance in Bangladesh

  • Governed by the Succession Act of 1925
  • Spouse gets 1/3, children share 2/3 equally
  • No gender-based discrimination

Inheritance in India

Hindu Succession Act

Under the Hindu Succession Act (amended 2005):

  • Class I Heirs: Mother, spouse, sons, daughters — all share equally
  • Daughters = Sons: Daughters have exactly the same rights as sons
  • Per Capita Distribution: Each heir in the same class gets an equal share

Example (Hindu Succession Act): A man leaves behind his wife, mother, one son, and one daughter. All four are Class I heirs:

Heir Share
Wife 25%
Mother 25%
Son 25%
Daughter 25%

Muslim Inheritance in India

  • Follows Muslim Personal Law (Shariat)
  • Similar to Bangladesh Muslim law
  • Fixed shares for Quranic heirs

Indian Succession Act (Christians)

  • Spouse: 1/3 of the estate
  • Children: Share the remaining 2/3 equally

Inheritance in the USA

The USA follows intestate succession when there's no will. Laws vary by state, but common patterns include:

Surviving Spouse + Children

  • Spouse typically receives 1/3 to 1/2
  • Children split the remainder equally

No Spouse

  • Children inherit equally
  • If no children, parents inherit

No Immediate Family

  • Brothers and sisters
  • Then grandparents
  • Then aunts, uncles, and cousins

Important: Each US state has its own inheritance laws. Use our Inheritance Calculator to see state-specific results.
